{"id":6190,"date":"2015-09-02T16:25:33","date_gmt":"2015-09-02T16:25:33","guid":{"rendered":"http:\/\/newscoverage.org\/?p=6190"},"modified":"2015-09-03T13:31:22","modified_gmt":"2015-09-03T13:31:22","slug":"beaconsfield-trashcams-raise-privacy-concerns","status":"publish","type":"post","link":"https:\/\/newscoverage.org\/index.php\/2015\/09\/02\/beaconsfield-trashcams-raise-privacy-concerns\/","title":{"rendered":"Beaconsfield trashcams raise privacy concerns"},"content":{"rendered":"<div class=\"page\" title=\"Page 33\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<div class=\"page\" title=\"Page 33\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p><strong><a href=\"http:\/\/www.thesuburban.com\">By Kevin Woodhouse<\/a><\/strong><\/p>\n<p>Following last week\u2019s decision by the Beaconsfield council to allocate the necessary funds to purchase garbage bins with RFIDs (Radio Frequency Identification) and install a camera on\u00a0the garbage collection trucks, some concerns have been raised about the potential invasion of privacy through the use of the new system, which is scheduled to be implemented in January 2016.<\/p>\n<p>The city\u2019s new system will have a camera in the collection vehicle permitting\u00a0the driver to\u00a0monitor and record imagery of the\u00a0trash. During the delivery sequence when the bin is loaded onto the truck, video imagery can see what is being tossed out, and also what and who is on personal property.<\/p>\n<p>If an offending item such as\u00a0an old electronic device like a television or toxic household waste such as paint finds its way onto the screen, a still image is taken.<\/p>\n<div class=\"page\" title=\"Page 36\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>\u201cUnder our new system, we want to eliminate offending garbage ending up in landfills and not the designated places they belong,\u201d Beaconsfield Mayor Georges Bourelle told <em>The Suburban.<\/em><\/p>\n<p>The image of the offense is \u201cthen sent to Public Works and then a communication is sent to the resident. We will be keeping the records in the event of repeat offenders but the records will be kept for a short time only,\u201d said Bourelle. What that \u201cshort time\u201d would be was not specified and contradicted statement to reporters last week\u00a0that the data will be stored indefinitently.<\/p>\n<p>Bins not properly placed or damaged will also be photographed in the hopes of advising the residents so that the problem can be fixed and \u201cthe truck can go back and get the collection on the same day in most cases,\u201d said the mayor.<\/p>\n<p>When asked if the city sought a legal opinion on the privacy issue, Bourelle said that the decision to use the RFID bins \u201cwas proposed by the previous council\u201d suggested\u00a0that <em>The Suburban<\/em> should consult members of the previous council for the answer.<\/p>\n<p>Bourelle confirmed that no legal opinion was sought on privacy issues. He then surprisingly suggested asking Suburban editor Beryl Wajsman his opinion on the matter because of his \u201capparent expertise on the\u00a0issue.\u201d<\/p>\n<\/div>\n<div class=\"column\">\n<p>Last Monday, <em>The Suburban\u2019s<\/em> editor\u00a0spoke with director general Patrice Boileau, who also informed Wajsman that no request for legal advice pertaining to privacy and consent issues had been made by council prior to last week\u2019s announcement.<\/p>\n<p>The next day, Karen Messier, councillor and head of the city\u2019s environment committee, released a Facebook statement citing a 2009 Supreme Court decision in R. v Patrick to justify the video surveillance of garbage on a public curb.<\/p>\n<p>But the Patrick decision dealt with criminal law. The judgment deemed that it was not a violation of Mr. Patrick\u2019s Section 8 Charter protection against \u201cunreasonable search and seizure\u201d for police to have taken and searched through a drug suspect\u2019s garbage because Mr. Patrick was complaining only that the officer in question had stretched his arm over Patrick\u2019s property line to get the garbage. The judgment did not address the civil privacy protections that we all have against unfettered video surveillance and data storage.<\/p>\n<p>Messier said that discussions of a legal nature and privacy concerns \u201cwere not factored into this so we were a little taken by surprise by some of the reactions we received.\u201d<\/p>\n<p>For resident Fran\u00e7oise Ortuso, the idea of pictures being stored \u201cis a violation of my privacy.\u201d<\/p>\n<p>Beaconsfield Citizens Association president Al Gardner told <em>The Suburban<\/em> that he has heard from residents on both sides of\u00a0the issue, some in support of the new measures while \u201cothers see it as an invasion of privacy.\u201d<\/p>\n<\/div>\n<div class=\"column\">\n<p>The city of Beaconsfield will be holding an information session on the waste collection procedures on Tuesday, Sept. 15 at the Herb Linder annex adjacent to city hall. The new collection protocol will\u00a0begin in the new year if no changes are made.<\/p>\n<\/div>\n<div class=\"column\">\n<p><em>The Suburban<\/em> editor Beryl Wajsman has obliged Mayor Bourelle\u2019s suggestion of consulting with him on privacy and he sets out his view, and those of experts, on the law and on Beaconsfield\u2019s initiative in <a href=\"https:\/\/newscoverage.org\/index.php\/2015\/09\/02\/the-right-to-be-let-alone\/\">his op-ed this week<\/a> on page 11.<\/p>\n<p style=\"text-align: center;\"><em>Note: Beaconsfield Citizens Association president Al Gardner pointed out that only one person\u00a0will operate garbage trucks in Beaconsfield.
